Terms and conditions

Object. These General Conditions of Use regulate the use of the ibegas computer application (the “Application”) and the website www.ibegas.com and www.ibegas.es (the “Website”) in Spain, whether with its current name or any other name under which it may appear in the future, of Estaciones de Servicio Ibegas, s.l., CIF B42826107 with registered office at Pol. Ind. Raos, Galera, 41, 39600 Maliaño (Camargo), (hereinafter “ibegas”). The Application and the Website are aimed exclusively at users residing in Spain. Users who reside or are domiciled in any other place and who decide to access and/or use this Application and/or Website must ensure that such access and/or use complies with applicable local legislation. By accessing and using this Application and/or Website you (“User”) acknowledge that you have read and accepted these General Conditions of Use and agree to comply with all its terms and conditions. Likewise, the User acknowledges and accepts that access and use of this Application and/or Website will be subject to the General Conditions of Use that are in force at the time they access them. ibegas reserves the right to modify these General Conditions of Use, as well as any other general or particular conditions that may be applicable. In such case, the User may notify ibegas of non-acceptance of any possible modification of these General Conditions of Use.

Contents. Through the Application and/or Website, ibegas offers the User a search service for free and low-cost service stations. The Application and/or Website provide the User with access to the information or content necessary to choose a service station according to their preferences. Said information or content will be provided by ibegas to the user. ibegas reserves the right to modify at any time the presentation, configuration and location of the Application and/or the Website, as well as the corresponding conditions of access and use. The Content provided through the Application and/or Website may be subject to eventual updates not reflected at all times in the Application and/or Website. ibegas acts as an intermediary between the EESS and the User in the provision of price, location, services and location information services. ibegas makes available to the User a tool to search for gas stations and ultimately save by refueling, the user exonerating Ibefy of any responsibility derived from the service offered by the service station.

Access and use. The User acknowledges and accepts that access and use of the Application and/or Website takes place freely and consciously, under their exclusive responsibility. Access to the Application and/or Website will be limited to those over 18 years of age. ibegas will not in any case be responsible for any use contrary to the Law, morality, good customs and public order that the User and/or third parties may make of the Application and/or Website, nor for any damages or losses that could be derived from it. The User undertakes to make appropriate and lawful use of the Application and/or Website in accordance with the applicable legislation and these General Conditions of Use. The User must refrain from making unauthorized or fraudulent use of the Application and/or or Website; access or attempt to access restricted resources of the Application and/or Website; use the Application and/or Website for purposes or effects that are illicit, illegal, contrary to what is established in these General Conditions of Use, harmful to the rights and interests of third parties, or that in any way may damage, disable or overload or impede the normal use or enjoyment of the Application and/or Website; introduce or spread computer viruses or any other physical or logical systems that are likely to cause damage to the systems and databases of ibegas, its suppliers or third parties, attempt to access, use and/or manipulate the data of ibegas, third parties , suppliers and other users; reproduce, copy, distribute, transform or modify the Contents, allow access to third parties through any form of public communication, unless there is authorization from the owner of the corresponding rights or it is legally permitted; obtain or attempt to obtain the contents using means or procedures other than those that, depending on the case, have been made available to you for this purpose.

Operating Conditions of the app. Access to the Application will be subject in all cases to the User’s prior registration by completing the corresponding form (“Registration Form”), which will be previously provided to the User. ibegas reserves the right to freely accept or reject the registration request by the User. Access and use of the Application will be subject to a username and password proposed by the user when filling out the Registration Form and access will be deemed to have been made by said User, who will be responsible in all cases for such access and use. The system will ask the User for permission to send notifications and geolocation, both necessary for the correct functioning of the Application, as well as the type of fuel used by their vehicle. The User will be responsible at all times for the custody of their password, assuming, consequently, any damages that may arise from its improper use, as well as from the transfer, disclosure or loss of it. In the event of forgetting the password or any other circumstance that poses a risk of access and/or use by unauthorized third parties, the User will have the password recovery tool with the possibility of creating a new one to replace the previous one. . From that moment on, the application will suggest different routes to the cheapest gas station or closest to the User’s location. Once that route has been chosen, the application will guide you through navigation to the location of the service station. The system will also allow the User to mark a destination, suggesting the best routes to gas stations by price or distance. ibegas offers a wide range of functionalities to the user such as distance, cost and time to reach the selected gas station, personalized alert services to the User, offer of promotions and services from the EESS, etc. Finally, ibegas will ask for a rating with optional comments from the user. ibegas is a free tool for the user and is not responsible for the quality of the information or services offered by the gas station through the platform, and is not responsible for any responsibility or compensation that may correspond to the service station or to user.

Data Protection. All personal data (hereinafter, the “Data”) that the User provides through the Registration Form will be integrated into a personal data file for which ibegas is responsible. For more information consult the Privacy Policy.

Notifications. ibegas may make the appropriate notifications through the
Application and/or Website, through the telephone number provided by the user in the availability request process and through the email address provided by the User in the Registration Form. The User, in turn, may send notifications to ibegas through the contact form.
Assignment. ibegas may assign its contractual position to any natural or legal person who succeeds it in the exercise of its business under any title. The User may not assign their rights and obligations under these General Conditions of Use without the prior written consent of ibegas.
Applicable law and jurisdiction. The Conditions of the ibegas application or website will be governed and interpreted in accordance with Spanish law. ibegas and the user, expressly waiving any other jurisdiction or applicable legislation that may apply to them, submit to the Spanish common law legislation and the jurisdiction of the Courts and Tribunals of Santander (Spain).
